Strategic Growth

McKool Smith set up shop in 1991 as a small Dallas firm of 13 trial lawyers. Not long after, the firm strategically and rapidly expanded to include offices in Austin, Houston, Los Angeles, Marshall, New York, and Washington, DC. The firm opened its Marshall office in 1996, and it quickly established a reputation as a “rocket docket” for patent infringement cases in the Eastern District of Texas. This led the firm to open its Austin office and launch an intellectual property litigation practice in anticipation of the patent litigation boom. In 2007, the firm added an International Trade Commission (ITC) litigation practice and a new Washington, DC, office in response to the popularity of the ITC’s popularity for resolving infringement disputes. Later that year, the firm opened an office in New York and to develop financial litigation and white collar defense practices. In 2011, the firm completed its nationwide expansion when it combined with Los Angeles-based Hennigan Dorman.

Behind the Trial

McKool Smith’s trial prowess speaks for itself. The firm achieved 19 “Top 100 Verdicts” in a ten-year span, which according to McKool Smith, is more than any other law firm. Recent high-profile victories include multimillion-dollar verdicts for clients like producer Quincy Jones in a contract and royalty dispute against Michael Jackson; WiLAN in a patent infringement suit against Apple; and Ericsson in a patent infringement suit against TCL. The firm also recently represented New Jersey Transit in an appellate win enabling it to recover up to $400 million in insurance proceeds stemming from losses related to Superstorm Sandy.

McKool Smith is serious about behind-the-scenes resources that help its lawyers achieve the best results at trial. The firm has as an in-house jury consulting service that provides pre-trial assessments and jury research to help hone in on the right themes and messaging, real-time consulting during trial, and post-trial jury feedback. The firm also offers in-house trial presentation systems and top-notch graphic creation tools that help attorneys put on the best case possible.

Serious about Diversity  

McKool Smith takes diversity seriously, and since January 2020 has retained Coston Consulting, a Black-owned business advisory firm, to help further develop and implement diversity initiatives. The firm is a partner to a number of associations, including the Leadership Counsel on Legal Diversity and local associations pushing to further diversity of all kinds in the legal profession. The firm’s internal practices include staffing diverse lawyers on the most substantive roles working with clients, hiring consultants who specialize in diverse recruiting, and incorporating mandatory diversity training into existing presentations and workshops.
