About Lightfoot, Franklin & White LLC

Lightfoot, Franklin & White has represented a broad range of clients in matters across North America, including in 43 states, U.S. Virgin Islands, District of Columbia, and Canada, to be exact. At the beginning of January 1990, eight litigation partners left one of Alabama’s largest firms to create a civil litigation firm of their very own. Since then, the regional firm has grown to over 60 lawyers that practice in commercial disputes, antitrust, securities fraud, internal investgations and much more.

Sweet Home Alabama

Lightfoot may represent clients across North America, but the firm’s Alabama practice has gone above and beyond. Lightfoot attorneys took the initiative to advise a long-standing client of an option to remove a liability/toxic tort suit to a federal forum. Before being contacted about the suit by the client, Lightfoot uncovered that the plaintiff had failed to serve the Alabama defendants and then removed the case under the federal removal statute which permits a removal where the resident defendant has not been “properly joined and served.” Plaintiff's counsel filed a Motion to Remand, which the District Court denied. The quick thinking by Lightfoot attorneys resulted in their client's case being defended in a better federal forum.

Lightfoot attorneys also successfully defended one of three pharmaceutical companies sued by the State of Alabama. The State alleged that Novartis Pharmaceuticals Corporation, along with dozens of other drug manufacturers, had reported false and inflated pricing terms, which caused the state to over-reimburse pharmacists who dispensed drugs pursuant to Alabama's Medicaid System. A Montgomery County jury found Novartis liable for fraud and awarded over $33 million in damages. On appeal, the Alabama Supreme Court reversed and rendered judgment in favor of Novartis, holding that one of the essential elements of a fraud claim—reliance—was missing from the State's case.

An Experienced Bunch

The lawyers at Lightfoot have quite the background in the legal field. They have included the former Chief Judge of the United States District Court for the Northern District of Alabama; a former Justice of the Alabama Supreme Court (who served on the Court for 20 years); a former Justice of the Supreme Court of the Republic of Palau; six Fellows of the American College of Trial Lawyers (one of whom is president and another who served as the College’s president from 2002–2003 and continues to serve as a non-voting member of the College’s Board of Regents), and much more.
