Kuchler Polk Schell Weiner & Richeson, LLC is a litigation boutique firm in New Orleans, with expertise in toxic tort actions, products and premises liability litigation, environmental cases, maritime claims, employment litigation and general business and commercial litigation. Founded in 2009, the firm is majority-woman owned, with four of the five equity and founding partners being female. Significant actions include representing DuPont in a qui tam false claims act case involving TSCA reporting provisions and defending the co-owner of the oil well involved in the Deepwater Horizon disaster (the BP oil spill).

In Wright vs. ANR Pipeline Company, 2016 WL 3268733 (5th Cir. 6/14/2016), the Fifth Circuit affirmed the trial court's dismissal of an ANR employee, whom the defendants (all of whom were represented by Kuchler Polk) claimed was improperly joined to defeat federal diversity jurisdiction. This decision was significant because the trial court had dismissed the claims of numerous plaintiffs on the merits after they could not meet their burden to show their claimed injuries were caused by the emergency shutdown at the ANR natural gas compressor station. Rather than appealing the dismissal on the merits, the plaintiffs chose to challenge the trial court's jurisdiction, and lost.
Simply Great Chemistry
The firm represented Union Carbide Corporation in Dan Freeman v. Phillips 66 Company, et al. The case involved an asbestosis claim against Union Carbide Corporation for alleged exposure to drilling mud additives. On August 10, 2015, the case proceeded to trial in Orleans Parish, Louisiana. After short deliberations, the jury returned a defense verdict.
On July 15, 2015, one of the firm's diverse female lawyers, Lori Waters, was appointed to serve a three-year term as a hearing committee member of the Louisiana Attorney Disciplinary Board. As a hearing committee member, Lori will be responsible for conducting formal hearings concerning lawyer discipline, disability, and reinstatement; review requests for appeals by complainants; and review requests for permission to file formal charges by the Office of Disciplinary Counsel.
Kuchler Polk is proud to be a signatory to the Louisiana State Bar Association's Diversity Statement. Further, Joseph "Jody" Hart, Senior Counsel with Kuchler Polk, has served on the Bar Association's Diversity Committee for the past three years and is immediate past co-chair of the Diversity Committee's Diversity Integration Subcommittee. The mission of the Subcommittee is to "[c]oordinate diversity-related programming to unite, support, and educate LSBA members on issues and topics of importance to those in the legal profession." Mr. Hart has undergone Bar-sponsored diversity training, gives presentations, and moderates diversity-focused Continuing Legal Education seminars as a participant in the Bar Association's Diversity Committee.
