Billion Dollar Deals
While million-dollar deal negotiations are run of the mill for DGS, the firm's clients are more often interested in riches of the "oil as black gold" variety. DGS served as counsel to PDC Energy Inc. its acquisition of two privately held companies managed by Kimmeridge Energy Management Company for approximately $1.5 billion. The transaction included approximately 57,000 net acres in the Delaware Basin of Texas with an average working interest of approximately 93 percent. The firm also advised Newmont Mining Corp. in its acquisition of the of the Cripple Creek & Victor gold mine from AngloGold Ashanti Ltd for $820 million.
The firm’s trial lawyers obtained notable defense verdicts for their client in recent years. In March 2016, following a 10 day trial, DGS received a complete defense verdict on behalf of their client, Deere & Company. The plaintiff alleged defects in one of John Deere’s small tractors after sustaining injuries while inappropriately using the tractor to lift a 1600 pound hay bale that was beyond the tractor’s stated capacity. Plaintiffs sought $47 million in damages.
In November 2016, DGS secured a complete defense verdict on behalf of Takata Corporation, a manufacturer of seatbelt assemblies. The plaintiff brought product liability claims against Takata for alleged seatbelt design defects, Honda, and windshield manufacturer AGC, and negligence claims against another driver after a 2013 car accident. The plaintiffs sought damages totaling $87 million for quadriplegic injuries sustained during a rollover accident.
