Established in 1977, esteemed Atlanta law firm Bondurant Mixson & Elmore is prepared to go to trial for its clients’ business law controversies. Supreme Beginnings

After winning a landmark U.S. Supreme Court voting-rights case at the age of 26, it’s no surprise that founding partner Emmett Bondurant wasn’t content to practice law at someone else’s law firm. In 1977, Bondurant teamed up with Mickey Mixson and Jay Elmore to form the firm. Bondurant Mixson bucks convention by not hiring laterals, which allows the firm’s collegial “culture of winning” to persist and means that every lawyer learns how to litigate from within.

Because Bondurant Mixson is focused on investing in and retaining skilled, experienced lawyers, the firm is highly selective when hiring new associates. Those who make the cut have graduated at or near the top of their law-school class, and almost every firm attorney has held at least one federal clerkship, with many clerking at the U.S. Court of Appeals level. Bondurant Mixson also invests heavily in its associates, including by sending all associates to NITA’s deposition training and NITA’s week-long trial training; the firm also arranges frequent in-house training opportunities.

Small Firm, Big Wins

This carefully crafted team allows Bondurant Mixson to attract a variety of high-stakes business-litigation cases. Not intimidated by big names or big firms, the firm challenged Turner Broadcasting System in a breach of contract case to sell businessman David McDavid the Atlanta Hawks, the Atlanta Thrashers, and the operating rights to Philips Arena and won a $281 million jury verdict—the largest compensatory damage award in Georgia history (and which was subsequently affirmed on appeal). Bondurant Mixson also recently served as plaintiff’s class counsel in an antitrust class action filed against Masco Corporation and the four largest manufacturers of insulation. The case settled for $112.25 million, one of the highest antitrust settlements to date in the state of Georgia. Among many other notable victories, the firm also holds claim to the largest collected jury verdict in Georgia history and the largest False Claims Act settlement in Georgia history. 

On the defense side, the firm has successfully reversed on appeal a $457 million judgment in a contract dispute over whether Weyerhauser had agreed to indemnify Paragon Trade Brands for patent infringement claims.  And, in 2017, Bondurant Mixson defended Delta Airlines and obtained a complete dismissal and affirmance on appeal of a massive RICO class action brought by plaintiffs alleging that seven major airlines conspired to charge travelers a tourism tax for U.S.-Mexico flights.
