My employer withdrew funds out of our checks for our 401K and never deposited the money into the account. They also did the same for health bennies and never paid those as well.
Could anyone provide me with the proper course of action that my ex-employees and I should take to resolve this issue.

You should run, not walk, to your nearest Department of Labor, Pension and Welfare Benefits Administration office and report your employer's malfeasance. This is the agency that has oversight of the integrity of employee benefit plans and enforces the fiduciary requirements of the law. I am a benefits professional with 20 years experience. The DOL lives for this type of thing, and will initiate a criminal investigation. Check the DOL's website for contact information. ACT NOW-don't let them get away with this!!!
