I'm working way more than 40 hrs a week as an intern, and have no benefits. I'm not even 'allowed' to put more than 40 hrs on my time card. Is this right? By law aren't interns supposed to get paid overtime? Please tell me how startups do this, please! |

under the fair labor standards act (FLSA) there are exempt (from being paid overtime) jobs and nonexempt (meaning they are eligible for OT) jobs. FLSA is defined by the US Department of Labor.
The FLSA defines these jobs and gives criteria. Many companies will call mostly every job exempt -- even if they are not. Some examples of "real" exempt jobs are programmer; manager; network architect; loan officer; purchasing agent, etc. Examples of nonexempt jobs are: clerk; cashier; assembler or manufacturing tech; various administrative jobs such as department assistant, etc. Many sales jobs are exempt as well.
IF you're in doubt, check the DOL's website; or maybe ask your HR department to audit the job.
On the other hand, to get the experience on your resume and a good reference as a "can do" person; it may be in your best interest to tough it out. Good luck~
