Company policy in general is to verify dates of employment, position and in some cases salary. I checked with Siebel and there policy is just that. If anybody gives a reference it would be outside of policy.
If a manager gives a bad reference and it's unfounded and not very well documented then there are definite grounds for litigation. That's why most companies adopt the name, rank and serial number only policy. It's to protect them from litigation. If a manager provides a bad reference then they should have a well documented performance history to substantiate the statements.
