NO, it doesn't work out this way - if Prisoner 3 was RED then:
Case 1: P2 would know that he has a black hat since P1 didn't see 2 RED hats in P2 and P3, and claim himself (P2) a black hat.
Case 2: P1 would know that he has a black hat since P2 didn't see 2 RED hats in P1 and P3, and claim himself (P1) a black hat.
Nutshell: Basically, if both P1 and P2 are wearing black and P3 a red hat, P2 would know immediately come his turn to answer the jailer that, he has a black hat, since P1 didn't see 2 red hats and claim himself a black hat(only P3 red).
