Recently a friend of mine was placed in a difficult situation. She currently works for a small insurance agency and was looking for a job which offered room for growth. She interviewed for a larger, more well-known insurance agency who happens to send business occasionally to her current small agency. My friend received a call from the interviewing company, and they told her that before they can consider her as a candidate for their opening, that she let her current boss know that she interviewed with them (because they are concerned about "stepping on any toes"). This leaves my friend in a tough spot. She wants to explore a possible opportunity with the larger interviewing company, but they have not PROMISED her a position there. If she lets her current boss know that she has been looking, she may get fired. Is it legal for the interviewing company to MAKE her tell her current boss? Because if she chooses not to, they said they cannot consider her application!

My advice: don't tell until you have a firm offer. In the exact case you describe, your friend may be better off passing on this opportunity.
