I was hired by a company a long time ago and had hoped to start working for them a year ago. However, due to the economy I won't be starting until now.
Here's my problem - my new employer wants collect information on my past employment again because it's been a year since I gave them my past employment info. In this past year, I had a bad experience where an employer hired me, then realized I didn't have the right skills and let me go. I want to put it behind me b/c it lasted only 5 weeks and I'm scared that my new employer may use it as an excuse to not hire me now.
Can I legally leave this off? I don't think I'm obligated to give this information to them anyway, or am I? What really is frustrating me is that they hired me a year ago and already did this check - this negative employment experience never would have occured if I hadn't had to wait to start.

Ok. If you have mentioned your 5 week employer, then you can later explain that it it was a filler job until you received a better fit. It is better that you not even mention the 5 week employer. Keep in mind that 5 weeks is nothing in the job world. If asked about the 5 week job, be honest, do not put the past employer down, just admit that you would do better at the new company because it is a better match for your skills, etc.
