In answer to your question, I cannot cite any experience at Columbia but am aware of a situation where a disabled employee was asked to apply for disability as part of a severance agreement. The employee declined because he was not currently declared medically disabled. This portion of the severance agreement was deleted. My advice is that you get a good employment attorney!
