I passed the powerday, and got an offer for a data analyst position, which I was pretty happy about, so I quickly declined the offer from another company -- I don't want to waste their time. The situation is I can work on OPT from 5/15-8/15 for full time, and by 10/1, I should have the H1B approved. That is, I can't work for these 6 weeks in between. When I told this to my recruiter, he said that I have to work continuously on a full time basis from day 1, otherwise he would have to withdraw the offer and then we need to go through the hiring process again in October.
I have a couple of friends working for capital one and I know they waited as long as 6 months for one of them before she started. So I was wondering if it's possible for me to work 3 months, and then get off for 6 weeks before 10/1. Is this a legal issue or is this largely depending on my manager?

The manager will be calling me early this week, but I am debating if I should tell this to my manager. I actually can have the work authorization during those 6 weeks on a half-time basis, but not sure if this is going to help a lot. I am afraid if I tell him now, he will have enough time to opt for another candidate, but if I wait until in May, it might be difficult for him to give me up. I can say that USCIS made a stupid mistake etc...
What do you guys think?
I will talk to my friends in C1, and see what they can do for me.
