Someone I know is a E level and works in a BPO and this is there situation. BPO supposed to be same as services.
Everything about the 120% rule
per pay period is correct except if you are an analyst(F and E level) in Services. Then you are not considered exempt and you will be paid for every hour over 40 in a week and in some states, more than 8 per day regardless of the weekly total. Something changed Sept 2004 with the Fair Labor Standards (something like that). All current BPO Services E and F's (not sure if this applies to all Services but hopefully someone will chime in, would have all the info. They even got paid retro back to 9/04 just this last September.
Resulting in the upper levels (d and c) ending up working the OT to avoid paying. |

Services - Hired 12/14/05 by ATS as a Systems Analyst.
The IRS has seperate OT rules for Tech people.
The gist:
Salary benchmark = $455.00 per week.
Hourly benchmark = 27.75.
(why the disconnect ? I don't know)
Below those levels, OT has to be paid.
So getting OT for hours after 40 is a bonus.
I took a shot applying with ATS.
Not sure why they wanted this old war horse.
I'm guesing I'm the oldest grunt there.
