Big Win for Big Pharma

Irell & Manella secured a complete defense win for client Gilead Sciences following a week-long trial in Delaware Chancery Court. The trial was the culmination of a contract litigation that arose from a merger of Gilead and Calistoga Pharmaceuticals in 2011 and Gilead's cancer-fighting drug Zydelig.

January 2017

Irell & Manella secured a dismissal with prejudice of a biometric privacy class action for New York-based Take-Two Interactive Software, a video game publisher and owner of the labels Rockstar Games and 2K. The lawsuit alleged violations of the Illinois Biometric Information Privacy Act. The plaintiffs argued that Take-Two had failed to provide information required by the Act when they used NBA 2K15's "My Player" feature to scan their face and create an in-game avatar based on the scan.

Electric Win for Tesla

Irell & Manella delivered an appellate win when the Ninth Circuit Court of Appeals unanimously affirmed a previously secured dismissal of a shareholder class action against Tesla Motors, Inc. and its founder and CEO, Elon Musk. The lawsuit was filed following two highly publicized incidents involving Tesla vehicles and alleged that the company failed to adequately disclose risks of fire from underbody collisions. The plaintiffs claimed the incidents revealed the risk and caused Tesla's stock price to drop.

Roping the Wind

Irell & Manella represented ConstructConnect (f/k/a iSqFt), a portfolio company of investment firms Genstar Capital and Warburg Pincus, in its sale to public company Roper Technologies, Inc. for a purchase price of approximately $632 million.

September 2016
Chinese Cinema

Irell & Manella represented Dalian Wanda Group in connection with its agreement to enter into a strategic alliance with Sony Picture Entertainment Motion Picture Group. The partnership capitalizes on continued growth in the world's largest international film market and will include equity co-financing in some cases, comprising a number of Sony Pictures' upcoming high-profile tentpole releases in China. The deal marks Wanda's first multi-picture partnership with a major studio.

Twinkle Toes

Irell & Manella successfully represented Skechers in a trademark infringement lawsuit involving Converse's claimed trademark in the midsole design of its Chuck Taylor All Star sneakers. Following a trial at the International Trade Commission, Converse's claimed trademark was found invalid. In addition, Skechers' Twinkle Toes and BOBS sneakers were found not to infringe, anyway. The case was recognized as the top trademark ruling of 2016 by a national legal publication.


The U.S. Supreme Court declined to hear Sequenom Inc.'s appeal of a decision invalidating its patent for a fetal DNA test, after lower courts found the patent ineligible because it is directed toward a natural phenomenon. More than 20 amicus briefs were filed asking the court to take the case causing some commentators to predict that the Supreme Court would grant cert. The decision gives Irell & Manella client Ariosa a complete and final victory in its patent litigation with Sequenom.
