Irell & Manella won a summary judgment ruling for CBS
dismissing a closely watched case brought by ABS Entertainment
involving the radio broadcast of pre-1972 sound recordings based on
a novel argument that CBS wasn't playing the original pre-1972
recordings. Rather, it played versions that were remastered years
later, using technology that changed and improved the sounds. The
remastered versions have a new federal copyright, which eliminates
any state law protection.
Irell & Manella represented Public Storage, a publicly
traded Fortune 500 company, in a complex merger litigation arising
from its acquisition by way of mergers of several limited
partnerships in which it served as the general partner. After a
two-week trial, the court ruled entirely in favor of Public Storage
and denied plaintiffs any recovery.
Irell & Manella represented Miramax in its acquisition by
media and entertainment company beIN Media Group.
Irell & Manella represented Calavo Growers and certain
officers and directors in the defense of federal securities act
claims relating to Calavo's January 2015 restatement of its audited
financial statements. The court twice dismissed the complaint-the
first time with leave to amend, and the second time with prejudice
in February 2016.

Irell & Manella represented Dalian Wanda Group Co., Ltd. in
connection with a definitive merger agreement to acquire Legendary
Entertainment for $3.5 billion. The transaction is heralded as
China's largest cross-border cultural acquisition to date.
Taking a Bite out of the Apple
On October 16, 2015, a federal jury in the Western District of
Wisconsin found that Apple Inc. owes Irell & Manella client,
the Wisconsin Alumni Research Foundation (WARF), $234.2 million for
patent infringement following a two-week trial. The damages verdict
